Jamie McGinn not suspended for hit on Aaron Rome
According to Dave Lozo of NHL.com Sharks forward Jamie McGinn will not be suspended for his hit on Vancouver defenseman Aaron Rome. The hit took place in the third period of game three in the Western Conference Finals.
Aaron Rome did not return to the game following the hit, having to be helped off the ice by team doctor Bill Regan and an assorted group of Canucks' trainers.
McGinn was assessed a five minute boarding major and a game misconduct on the play.
Here is what the NHL rulebook states in regards to boarding penalties.
41.1 Boarding – A boarding penalty shall be imposed on any player or goalkeeper who checks an opponent in such a manner that causes the opponent to be thrown violently in the boards. The severity of the penalty, based upon the degree of violence of the impact with the boards, shall be at the discretion of the Referee.
There is an enormous amount of judgment involved in the application of this rule by the Referees. The onus is on the player applying the check to ensure his opponent is not in a vulnerable position and if so, he must avoid the contact. However, there is also a responsibility on the player with the puck to avoid placing himself in a dangerous and vulnerable position. This balance must be considered by the Referees when applying this rule.
41.2 Minor Penalty – The Referee, at his discretion, may assess a minor penalty, based on the degree of violence of the impact with the boards, to a player guilty of boarding an opponent.
41.3 Major Penalty – The Referee, at his discretion, may assess a major penalty, based on the degree of violence of the impact with the boards, to a player guilty of boarding an opponent (see 41.5).
41.4 Match Penalty – The Referee, at his discretion, may assess a match penalty if, in his judgment, the player attempted to or deliberately injured his opponent by boarding.
41.5 Game Misconduct Penalty - When a major penalty is imposed under this rule for a foul resulting in an injury to the face or head of an opponent, a game misconduct shall be imposed.

As we can see in the video, McGinn begins coasting into the hit when he reaches the near-side circle. He uses his momentum to carry him into the play, meaning that a charging call is not applicable here. Furthermore, McGinn does not make principal contact with Rome's head and does not hit him between the numbers-- at the 0:50 mark of the clip we see that he actually turns his body away from the hit, clipping Rome's left shoulder and driving him into the boards.
The only issue from the play, and the likely reason it went to the League office, is that McGinn is lining up his hit all the way throughout the zone. He does not make any attempt to play the puck or cut Rome's angle short, with his vision squared solely on making the hit. Furthermore, the fact that this was the second game misconduct of the postseason (his first coming in game six of San Jose's first round series against Los Angeles) means that the League Office obviously wanted to make a statement that they will be reviewing players who have prior history with these types of hits.
Most importantly, the optics of the play and Rome's subsequent injury from the hit played a large part in the review as well.
The League got this one right-- McGinn received a five minute major as well as a game misconduct in lieu of his hit on Rome, making it sufficient punishment for a play that has generated debate as to whether it even warranted a major due to the fact that it is a common hit in the NHL postseason. At that stage in the game however, McGinn must be cognizant of the score and situation of opposing defenseman-- and while you never want to ask a player to turn his motor off, especially when that motor is the primary reason he has been effective, the microscope will clearly be on him going forward.
McGinn's physical play throughout game three resulted in two injuries to Canucks defenseman, as both Christian Ehrhoff and Aaron Rome are questionable for game four tomorrow afternoon in San Jose. The newly assembled fourth line of Jamal Mayers, Andrew Desjardins, and McGinn was strong on the puck and active in the offensive zone, accounting for the fourth lines most effective game of this postseason at even strength. However, their issues with penalty trouble (Desjardins played part in two separate 5v3's in the second, McGinn's major resulted in two power play goals for Vancouver) is something that will need to be harnessed if they hope to continue receiving playing time.
In other Sharks news, Mark Emmons of Working The Corners is reporting that Logan Couture practiced today but Jason Demers did not.

One quibble
Jamie McGinn did NOT get a game misconduct in the game versus LA. He got a 5 minute major. If he had, he would have been automatically suspended for 1 game per rule 23.3 (http://www.nhl.com/ice/page.htm?id=26306) which states that 2 game misconducts in the playoffs results in an automatic 1 game suspension

McGinn is automatically suspended for the next game anyway,s o if there were to be supplemental discipline it would have to be worthy of a 2 game suspension.
McGinn is suspended next game I believe because of a rule that stipulates that any player given 2 game misconducts within the same playoff year is automatically given a 1 game suspension.

McGinn does not receive an automatic suspension. Here is Rule 23.3:
In Playoff games, any player who incurs a total of two game misconduct penalties in the "General Category" shall be suspended automatically for the next Playoff game of his team. For each subsequent game misconduct penalty during the Playoffs, the automatic suspension shall be increased by one game. For each suspension of a player during Playoffs, his club shall be fined one thousand dollars ($1,000).
For a list of infractions involving game misconducts that are included in the "General Category", please refer to the Reference Tables – Table 10 – Summary of Game Misconduct Fouls Included in the "General Category". See specific rule numbers for complete descriptions.
Here is the general category. Charging (G6 vs. Los Angeles) is in the general category. Boarding is not.

I think the biggest thing I’m taking away from all this, in some ways, is that the league still isn’t clear on if it’s penalizing infractions or injuries. Personally, I think you punish infractions and they got it right here. But it’s pretty clear that not everyone agrees (including the Canucks according to interviews with the Merc/WTC’s Mark Emmons).
Bieksa for example: "But you just look at the injury that happened on the play and obviously Aaron was pretty banged up. But the league saw it differently, I guess."
The league needs to step up and say “We are punishing the action” or “We are punishing the injury” or “Both things will be considered.” Right now we’re in limbo where they’ve said both of the first two things and done all three.

I liked McLellan’s take on it. He won the game so he says that McGinn deserved the five minute major. If it’s the other way around though I’m sure San Jose is probably crying foul as well. Either way, smart move by TMac.
The whole Weel of Justice thing is such a fucking charade. Like you said, over the course of the League’s disciplinary history they’ve punished the action and/or the injury, but there’s no consistency on a case by case basis. One time it’s injury one time it’s action.
Hoping for consistency is like hoping for the Sharks to buckle down in the third period and bury a team though— not gonna happen.

It's that we can't figure out why he's playing constantly over Ballard
We get that Rome is the stay-at-home type, and if we notice him something bad happened for us (Game 2 goal aside).
But it’s more that when Rome is playing, Ballard is sitting. And that’s what gets to us.

my thoughts on McGinn
it may have been a legit call, it may not have been… but if the refs are calling hits like that, JM probably needs to play smarter. A hit like that is going to possibly draw a penalty anyways… so, I won’t defend him completely.

Sorry you got hurt. No, really. Hate to see any player from any team get hurt. Uh, here’s the thing. When you got the puck along the boards, you really need to be aware of what’s going on around you. Perhaps you thought this was the women’s league and that there was no hitting. Easy mistake to make while watching an NHL game when the refs award a 5 minute penalty for a clean hit. But for what’s it’s worth, the Nucks fans are in tears over that hit (see previous post). Apparently they think you shouldn’t have to get hit, and should be in the previously mentioned woman’s league. Of course, the hit is going to be less drastic if you would just not forget to look over your shoulder once in awhile, you know, and maybe even get out of of the way, brace for impact or just not forget there’s opposing players on the ice. So, yeah, here’s to a speedy recovery. We can only hope your fans recover from their PTSD equally quick.

Its another example of people that choose to continually blame the hittee, and not the hitter. I know some think they actually know the game on some of thse forums, but really, they know jack. McGinn lined it up a long way away. He knew he was not going to get there before the puck.
He hit a guy well after the puck was gone, and that is why he got the penalty. But its not a clan hit because the puck is not there.
I know this is not my friends at FTF and rather some beer leaguer that thinks he knows the game. The yapping Nucks fans is sad though. No one is in “tears” at all. Rather, we see all season long people get suspended for a clean hit, as you call it ( late and in the numbers…just admit you don’t really know the game, mystery Hockey News forum writer )
The other babbling I don’t understand. I know its confusing. The contact itself was not that bad, he did not go for the head with a jump or anything. But, even in women’s league, you just do not do that. It was a stupid hit.
Thats why he was penalized. It was not intent to injure, thats why I am OK with no suspension.

I can’t remember the team. Maybe LA?, but there was much wringing of hands for a hit Murray put on a King (?) at the blue line, and it was the same, in that he was reaching for the puck, and had his head down the whole time.
This was along the boards, and Raffi is perpendicular rather than in front of the guy, but the same thing.
Murray had no call. He went through the head far worse than Raffi did.
Like I said earlier, I get that its a penalty in today’s climate. But the folks that argue that Raffi did something dirty, its just not true. He hit in the textbook way you would teach a kid. Shoulder braced. elbow down.
I think he was ready to make a big hit, and Eberle reached for the puck instead of looking up and seeing him coming!
Its a physical sport. Going into the corner, and not even looking once, when you have a defenseman on you, and you know a winger should be somewhere close by…

It can’t all be on the hitter in that situation. I imagine if you did a chart of all the hits in the NHL, the vast, vast majority would be in the corners, where it curves.
I tend to look both ways when I cross the street too…but thats just me.

What gets me is that, if Rome wasn’t on the ice bleeding, none of us would even be in here talking about clean vs. dirty, suspension or no suspension, destroying a bias Canucks fan vs. not destroying a bias Canucks fan, etc. I hate that the referees’ assessment of an action is influenced by what happens in the wake of the action. Hitting a guy the way McGinn did is either a penalty or it isn’t. The fact that Rome got hurt SHOULD be irrelevant.

Please stop with the winning of arguments, and just go with the facts. The Torres hit was clean by about half the hockey worlds opinions, and dirty by the other half. It was pretty controversial. I thought the former.
Bringing it up to win an argument about a hit that everyone but a Shark fan trying to rationalize agrees was a five and a misconduct does not help.
It just distracts. McGinn saw the numbers and had time to make that decision. The Torres hit was bang bang as well.

BTW…complaining about an obviously right call when you get double digit power plays in the same game is not the best form!
Not going to bother arguing it with you my friend, because I just don’t have the time to actually explain the rules of the game to you. But that was the most obvious of the 17 or so total penalties in the game. You do know its illegal to hit a guy in the numbers, especially after the puck is gone right?
I am actually surprised some Shark fans actually complained about this call. The guy is lucky he was not suspended, the way the NHL calls hits to the numbers these days. Maybe in the old days you would have an argument.
That is the most cut and dried call these days. Its almost as automatic as a puck over the glass in your own end!

All of what you just said is completely irrelevant.
I didn’t compare hits (though you could in some sense). You came here to preach about not blaming the hittee and yet, when Torres blindsides a guy in the head because Eberle was going for the puck and Torres saw an open target you blamed the guy that got clocked.
The section I bolded of your comment can apply directly to this situation as well. Rome goes for the puck, ignores his surroundings, McGinn keeps his elbow down and plows into him shoulder to shoulder. That’s what you defended for Torres and came here to preach against about Rome.
Maybe you think that it’s just okay for your team to clock guys in the head and others need to lay off when approaching guys with Shamoo on their chest?

Yes, the hittee has the obligation to keep his head up, but there are always going to be times when someone is exposed. It’s a dynamic game, and if you miss one read, you could find yourself being hit in an exposed area.
McGinn reads the situation the whole way, and I really don’t like his decision to turn his body away from Rome. I know it technically meant he wouldn’t hit him in the numbers, but it also greatly reduces his control on the hit in that situation.
“Clean” or not, Rome’s head does get driven into the boards (and no, it was not the principal point of contact). I’m going to maintain it’s a dumb hit, even if it’s legal.

It was a dumb play, which Ginner is prone to do. But it’s an acceptable play by the NHL and yes, a better decision could have been made. Yet it’s a fast pace game and a clean hit resulted in a freak accident brought on by poor decisions by both players.

McGinn has to make a better decision, but at his speed, he probably thinks he is. He’s aiming for “not the numbers,” but given Rome’s position on the boards, which I think is a totally acceptable place for him to be, and not necessarily inviting trouble the way some other hit victims have, I think he has to choose not to play the body there. It’s like the 1 in 100 situation where I think McGinn has to choose not to play the body. It’s an understandable mistake, but I still find it dumb because the whole thing should be a red flag.

Watching the clip again, I can’t really say I fault Rome too much on this hit. He’s skating along the boards, waiting to receive the puck. About the only thing he does that’s questionable in my eyes is chose to play the puck on his backhand. Otherwise, he’s not turning into the boards to protect the puck the way a lot of guys do sometimes.

75% of hits along the boards occur after the puck leaves. And Kesler’s slash at the end of the game was way more vicious than McGinn’s check — which, by the way, was NOT in the numbers. Even the VS guys, who are notoriously anti-west coast, said it wasn’t in the numbers. The fact of the matter is: if Rome doesn’t get hurt, there’s no penalty called on that hit. It would just be regarded as an excellent hockey hit. Canucks fans are digging for fault, because it is painful to watch your guy get hurt — I totally empathize with that.

Well there’s proof the contact was not in the numbers. So technically there is nothing wrong with this hit, besides the fact that Rome’s face had a bad date with the boards.

in defence of the rules
41.1 Boarding – A boarding penalty shall be imposed on any player or goalkeeper who checks an opponent in such a manner that causes the opponent to be thrown violently in the boards. The severity of the penalty, based upon the degree of violence of the impact with the boards, shall be at the discretion of the Referee.
There is something wrong with the hit depending on the violence the player is thrown into the boards.
Do I want Ginners to make this hit again… yes. 100% yes. FUCK yes. It’s what opponents have been doing to the Sharks for years in the playoffs.
Is it a boarding penalty? Yes. Major? Probably not, but the refs have been horrible as usual.
Numbers or not, let’s focus on the language of the rules so we don’t seem like tin-hat wearing Red Wing fans.

Watch the video again. And then again. McGinn got there while the puck was still there. Christ, if this was a Shark’s player laid out by a Canuck, you wouldn’t even care. Likewise, I’m sure, when Wellwood got double-teamed by two Canucks along the boards. Getting hit by 2 guys at time is perfectly fair, but this hit completely wrong. I’m sure that makes sense in Vancouver. Don’t pretend like you’re the expert in house, just say you’re upset that one of your guys got hurt. And while you do that, say you’re equally upset about the multiple sticks to the faces that your guys have delivered to our guys. You want to come in here and express a different viewpoint, that’s fine, but do it without being condescending. This is not Nuck’s Misconduct.

But honestly Jamie McGinn, what are you thinking?
The player is right up against the boards, and you’ve been burned this way before. It’s just not smart. You have all the time in the world. You can change your angle and come at him from the front and still hit him hard but not drive him into the boards when he’s exposed. You can wrap him up and take him into the boards. Hell, you could steal the puck.
We had to put in a helluvan effort in LA to kill that 5 minute major. Here, he had already knocked out Ehrhoff or else this one might’ve been bad too on the PK.
But 2 games and 2 ejections for hits that, while not necessarily suspendable, are just plain dumb, I’m not liking the odds going forward.
I love that Ginner is out there playing with some fire and trying to contribute, and we need more contributors and fewer passengers, but I really don’t know how McGinn is going to expect to stay in the lineup like this.

Take a look at the picture above that clearly shows he made contact on his shoulder. Yes it may have not been the smartest hit giving is past transgressions but to keep implying that he some how came directly behind Rome and hit him in the numbers is blatant ignorance.
What does hitting in the numbers have to do with anything? Did we start talking about the Eager hit? That one was dirty and in the numbers.
McGinn finished his check, shoulder to shoulder. League agrees with us on this one.

It was certainly a boarding call according to the rule. The problem I have with this guy is he keep coming over to FTF and talk about how McGinn hit Rome in the number. And his total disregard for his own hypocrisy.

Definitely not worthy of a suspension.
Obviously, he had little time to think at the speed he was traveling. However, you can see in the slo mo that Mcginn attempted to cut to Rome’s shoulder. I was more concerned about Kesler’s unnecessary slash on Vlasic at the end of the game.

so...
maybe some folks are on line and can help me make a decision for game time today. I have a choice. I can either, A), stay in my home and watch the game on the TV in the back room (there will be guests over today, which is slightly annoying to me)

or B), I can go to a sportsbar with my dad and catch the game there.
The downside to the first is, well, I kinda hate to see my dad going to a sportsbar alone to watch the game… but the downside to the second is that I’ll miss a significant amount of the first period if I go with my dad… plus, if I go with him, he might be embarrased by my tinfoil hat… lols.
I think this is one of those days where I can’t allow myself to be a superstitious fan… in either scenario there is too much room for blame if the Sharks lose (myself or my father being the respective targets). That said, it’s still not necessarily an easy decision.

Glad we’re all still here (not that was all that concerned—my only worry was the possibility that people would panic come 6pm and they realized they still had to make dinner and live their lives).
